DERECHOS FUNDAMENTALES EN EL SISTEMA CONSTITUCIONAL CANADIENSE: ENTRE LA CARTA CONSTITUCIONAL Y LOS CÓDIGOS PROVINCIALES

El objetivo del presente texto consiste en describir el sistema de reconocimiento y tutela de los Derechos Fundamentales en el derecho constitucional canadiense, en el que existe una carta de derechos con valor constitucional, así como una pluralidad de leyes ordinarias provinciales y federales que tratan las mismas materias. A fin de explicar este sistema de protección de derechos y de comprender mejor las interacciones en juego, particularmente del carácter federal de la constitución canadiense, el presente trabajo analiza sucesivamente la jerarquía de las normas en el sistema constitucional canadiense, la economía del reparto de competencias legislativas, estudiando después la Charte canadienne des droits et libertés
para poder finalmente examinar los regímenes provinciales de protección de esos derechos y libertades.
Testu honetan, Kanadako konstituzio-zuzenbidean oinarrizko eskubideak aitortzeko eta babesteko ezarritako sistema deskribatzen da; izan ere, zezenbide horrek konstituziobalioa duen eskubide-gutun bat jasotzen du, gai horri buruzko hainbat lege arrunt probintzial eta federalekin batera. Eskubideak babesteko sistema hau eta jokoan dauden interakzioak hobeto ulertzeko ¿bereziki Kanadako Konstituzioaren izaera federalarenak¿ testu honek hurrenez hurren aztertzen ditu Kanadako konstituzio-sistemako arauen hierarkia, legegintza-eskumenen banaketaren ekonomia eta, ondoren, Charte canadienne des droits et libertés gutuna eta, azkenik, eskubide eta askatasun horiek babesteko dauden araubide probintzialak.
The scope of the present text is to portray the system for the recognition and protection of fundamental rights within the Canadian Constitutional law, where there is a bill of rights with constitutional force and also a plurality of provincial and federal ordinary acts that deal with the same issues. With the purpose of explaining this system for the protection of fundamental rights and for the sake¿s of a better understanding of the interactions at stake,
especially the federal nature of the Canadian constitution, this work analyses successively the hierarchy of the norms in the frame of the Canadian constitutional system, the economy in the distribution of legislative competences, by then studying the Charte canadienne des droits
et libertés in order to finally examine the provincial regimes for the protection of rights and liberties.
